Petitioner seeks bail in a case registered under Sections-326, 307, 120(B) & other minor sections of the Indian Penal Code.
Petitioner is named in the first information report on the accusation that he as well as other accused instigated the coaccused Sunny to kill the deceased, upon which, co-accused Sunny opened fire, causing death of the deceased. Submission on behalf of petitioner is that having more or less similar allegation, one co-accused namely, Sujeet Kumar @ Sujeet Kumar Srivastava @ Sujeet Srivastava has already been granted privilege of bail by a coordinate bench of this court vide
Patna High Court Cr.Misc. No.26982 of 2016 (3) dt.18-07-2016 2/2 order dated 17-05-2016 passed in Cr. Misc. No. 15083 of 2016, whereas; the petitioner is languishing in jail custody since 02-122015. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Buxar (Town) P.S.
