JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Valmikinagar P.S. Case No. 68 of 2018 registered for the offences punishable under Sections 409, 420 and 34 of the Indian Penal Code.
Allegation against the accused persons, including the petitioner is that without any approval they have paid 7,41,80,640.34 against the sanction amount of Rs.38,63,917.40 and FIR disclosed that payment has also been made by the petitioner.
Submission of learned counsel for the petitioner is that petitioner was only there for three months and only on the approval of higher authorities he made the payment, as such there is no question of misappropriation. It is also submitted that
Patna High Court CR. MISC. No.39485 of 2019(2) dt.27-06-2019 2/3 other co-accused person has been granted the privilege of anticipatory bail by this Court vide order dated 31.1.2019 passed in Cr.Misc.No. 80115 of 2018.

In view of above facts and circumstances, let petitioner surrender in the court below by 10.7.2019 and on surrender he shall be released on provisional bail till submission of charge sheet on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bagha, in connection with Valmikinagar P.S. Case No. 68 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that petitioner has to cooperate in the investigation and produce all the documents before the I.O., who will examine the same. However, even after that if the charge sheet has been submitted against the petitioner he has to surrender and make prayer for regular bail, which shall be considered on the basis of materials available on the record at that time.
