JUSTICE SUDHIR SINGH ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 364A/34 of the Indian Penal Code.
Allegation is that informant's husband had gone with the petitioner and one co-accused and thereafter he did not return. On next day petitioner demanded ransom of Rs.50,000/- and victim's daughter aged about 15 years from the informant. It has been submitted on behalf of the petitioner that he is in custody since 1.5.2015. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. Approximately one month prior to the institution of the present case, a similar case was instituted by the victim against the petitioner with the allegation of abducting the daughter of the victim. There is admitted love affairs between the petitioner and the victim. In the earlier case the petitioner has been granted bail vide Annexure-1 to the present application. Hence, the present case has been instituted only to harass the petitioner with false allegation. The alleged occurrence is said to have taken place on 27.4.2015 but the case was instituted
Patna High Court Cr.Misc. No.26167 of 2016 (3) dt.18-08-2016 2/2 on 30.4.2015. Delay has not been explained by the prosecution. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge,Bettiah, West Champaran, in connection with S. Tr. No. 446 of 2015 arising out of Majhaulia P.S. Case no. 180 of 2015. (Sudhir Singh, J) sudip/- U T
