2. This is the second attempt on behalf of the petitioner for grant of bail in connection with Maharajganj P.S. Case No. 200 of 2023 registered for the offence punishable under Sections 304B, 201/34 of the Indian Penal Code.

3. Earlier the bail application of the petitioner has been rejected vide order dated 18.04.2024 passed in Cr. Misc. No. 10917 of 2024.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 07.08.2023 and in the trial three witnesses out of nine witnesses have been examined.

5. Considering the delay in trial and the period of custody, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Siwan/ concerned Court in connection with Maharajganj P.S. Case No. 200 of 2023.

7. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed in the trial. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.

8. At the time of accepting bail bonds of the petitioner, the trial Judge will verify the fact as to how many witnesses were examined till 11.06.2025. If the trial Court finds only three witnesses were examined till 11.06.2025 (the date of swearing the affidavit filed in this Court), the bail bonds of the petitioner shall be accepted. If the statement of the petitioner is found false, appropriate order shall be passed. (Sandeep Kumar, J) P. Kumar U T
