JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 15-06-2016 Heard learned counsel for the petitioner as well as learned APP for the State.

After receiving confidential information, a raid was conducted in the hut of Sukumar Yadav @ Shiv Kumar Yadav wherefrom five persons were apprehended including the petitioners. On search of the hut, Ganja weighing 5 Kilograms, balance and other items as per seizure list including motorcycle were seized. Nothing has been seized from the personal possession of the petitioners.

Furthermore, from para-3 of the petition, it is evident that petitioners have got no criminal antecedents. Co-accused, Babban Kumar @ Baban has already been granted bail vide Cr.Misc. No. 19420/2016.

Accordingly, petitioners, namely, Kavindra Ram and

Patna High Court Cr.Misc. No.25250 of 2016 (2) dt.15-06-2016 Udgar Ram are directed to be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Sessions Judge-cum-Special Judge, Saharsa in connection with Special Case No. 01/2016 (arising out of Saharsa Sadar PS Case No. 212/2016), subject to condition that future involvement in such kind of activity will be a good ground for cancellation of bail.
