JUSTICE RAKESH KUMAR ORAL ORDER 08-07-2015 Learned counsel for the petitioner, at the very out set, in presence of learned State Counsel as well as Sri Jai Prakash Singh, learned counsel for the Respondent no.6, submits that the present writ petition pertains to a mutation dispute, which is to be adjudicated by the Bihar Land Tribunal.

Keeping in view the fact that the Tribunal, constituted under the Bihar Land Tribunal Act, 2009 is already functioning, the Court considers that this matter can well be adjudicated by the Bihar Land Tribunal.

Accordingly, in view of submission made by learned counsel for the petitioner as well as in terms of proviso to Section 15 of the Bihar Land Tribunal Act, the Registry is directed to transmit the record of the case to the Bihar Land Tribunal forthwith.
