2. Petitioner apprehends arrest in Nautan P.S. Case No. 103 of 2026, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, total 72 liters of illicit country made liquor was recovered along with Motorcycle bearing no registration No.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. Petitioner has got no concern with the alleged recovery and he has been made accused in this case only on suspicion.

5. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.43694 of 2026(2) dt.08-07-2026 2/2 bail and submits that recovery has been made from motorcycle and petitioner has got five criminal antecedents out of which four are of similar nature.

6. Considering the nature of accusation and criminal antecedents of the petitioner, prayer for anticipatory bail of the petitioner is refused.
