The petitioner filed this petition for cancellation of bail granted to Raju Sahni, opposite party No.2.

It is submitted that opposite party No.2, after being released on bail, threatened the petitioner not to depose in the case. The information was given to the police officials. On perusal of the records, it appears that opposite party No.2 happens to be husband of the daughter of the petitioner and opposite party No.2 was granted bail on merit because his wife died in Naihar and she was under treatment of Dr. Vijay Prakash. I do not find it a fit case for cancellation of bail granted to opposite party No.2 as he neither misused the privilege of bail

Patna High Court Cr.Misc. No.41099 of 2015 (2) dt.16-09-2015 2/2 nor committed any crime, while on bail, nor made any attempt to tamper with the evidence.

The petition for cancellation of bail is, accordingly, dismissed.
