The petitioner seeks bail in Gaighat P.S. Case No. 106 of 2019, registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

15 liters of country-made liquor has been recovered from the motorcycle of the petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. The motorcycle in question does not belong to this petitioner. Petitioner is in custody since 27.04.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the quantity of recovery and period of custody, the bail petition of petitioner is allowed. Let the above

No.51397 of 2021(2) dt.29-11-2021 2/2 named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Gaighat P.S. Case No. 106 of 2019.
