Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 447, 341, 323, 504, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is in custody since 02.09.2018. Allegation is that he twice fired at the informant. The first hit at the chest and the second at the shoulder.

In the past, prayer for bail was refused on 07.05.2019. Submission is that petitioner is ready to cooperate with the trial. There is no material to substantiate that the petitioner is going to tamper with the evidence. The trial has not been concluded in spite of direction of this Court for conclusion

Considering the period already undergone by the petitioner and he is ready to cooperate with the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Session Trial No. 604 of 2019 arising out of Paliganj Police Station Case No. 90 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
