Petitioners seek regular bail in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code.
As per the prosecution case, while the informant caught one Niraj Singh, accused of Mahindwara 80/2021, this petitioner along with two other named and 10-15 unknown persons attacked on police party with Lathi, Danda, iron rod and tried to get free Niraj Singh and they also snatched arms of police party.
Learned counsel appearing for the petitioners submits
Patna High Court CR. MISC. No.53442 of 2021(2) dt.02-12-2021 2/2 that petitioners are innocent and have falsely been implicated in the case. There is general and omnibus allegation against these petitioners. It is submitted that, as per allegation, two policemen were injured but they received simple injuries. Petitioners claim clean antecedent and are in custody since 20.06.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate-I, Sitamarhi in connection with Mahindwara PS case No. 94/2021.
