JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code. Allegedly, petitioner was caught on the spot while he was carrying stolen articles on a thela.

Submission made on behalf of the petitioner is that the petitioner was going to Kabari shop and as a matter of fact, the articles were being carried by the petitioner to store in his godown. Moreover, investigation of this case has already been completed and it has not come in the investigation, as to from where, the aforesaid seized articles had been stolen. The petitioner does not have any criminal antecedent and is languishing in jail custody

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhubani in connection with Pandaul P.S.
