Petitioner seeks bail in a case registered for the offences punishable under Section 379 I.P.C.

Petitioner is in custody since 07.03.2020. The FIR of the occurrence of dacoity is against unknown. Submission is that the petitioner was never put on T.I. Parade rather he was remanded from some other case to this case only on statement before the police while in police custody. Learned counsel points out that in para-3 of the petition some criminal cases are referred but except in one case the petitioner is not named in the FIR.

Considering the completion of investigation and lack of material against the petitioner for the purpose of consideration of this prayer for bail, let the petitioner, above

Patna High Court CR. MISC. No.38317 of 2020(2) dt.12-02-2021 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Desari Police Station Case No.346 of 2019 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
