24-03-2021 Heard learned counsel for the parties.

This is 2nd attempt for grant of bail on behalf of petitioner in Sessions Trial No. 447 of 2019, arising out of Lauriya P.S. Case No. 42 of 2019. Earlier, vide order dated 20.11.2019 passed in Cr.Misc. No. 53867 of 2019, the prayer for bail of petitioner was rejected.

On last date i.e. on 10.02.2021, a report was called for from the court below regarding stage of the trial, which has been received and kept at flag 'A'. From perusal of the same, it appears that out of ten chargesheeted witnesses, five witnesses have already been examined, whereas, 6th witness namely Bhulan Kushwaha is partly cross-examined and rest four witnesses, including doctor and I.O., are to be examined and the case is pending for further evidence of prosecution.

Patna High Court CR. MISC. No.39037 of 2020(3) dt.24-03-2021 2/2 Considering the aforesaid facts & circumstances and the stage of the trial, the bail application of petitioner is rejected. However, the learned Trial Court is directed to conclude the trial as early as possible.
