The petitioner seeks bail in a case instituted for the offence under Sections 395 and 397 of the Indian Penal Code. It is alleged that this petitioner fired on staff of the informant Raju Kumar Sah on his wine shop and thereafter all the miscreants run away from the place of occurrence. Learned counsel for the informant and learned A.P.P. have stated that all the witnesses have supported the case and doctor has found gun shot injury on the person of the Raju Sah, which was found by doctor to be grievous in nature. In the circumstances and taking in view that there is specific allegation against this petitioner and nature of injury was

Patna High Court Cr.Misc. No.53754 of 2016 (4) dt.30-01-2017 2/2 found to be grievous in nature, I am not inclined to enlarge the petitioner on bail.

Accordingly, the prayer for bail of the petitioner is hereby rejected in connection with Pranpur P.S. Case No. 39 of 2016, pending in the court of learned Chief Judicial Magistrate, Katihar.

The petitioner is at liberty to renew his prayer for bail after six months, if no substantive progress is made in the case.
