The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Motihari Town P.S. Case no. 493 of 2023 instituted for the offence under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

Prosecution case in nutshell is that while the informant along with his friend have gone to the restaurant, petitioner and other co-accused persons surrounded him and started abusing in the wake of old dispute. It is further alleged that they assaulted him with knife due to which he sustained injuries. Petitioner is alleged to have snatched Rs. 2,200/- from the pocket of informant.

Patna High Court CR. MISC. No.45908 of 2024(2) dt.02-07-2024 2/2 Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Neither the petitioner was arrested on spot nor any incriminating article has been recovered from his conscious possession. There is case and counter case between the parties. Both parties have sustained injuries as alleged in separate occurrence. From perusal of the injury report, it appears that the injury sustained by the informant is simple in nature. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail.

The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Motihari Town P.S. Case no. 493 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
