Sessions Judge-IV, Begusarai in Sessions Trial No. 863 of 2008 arising out of Bhagwanpur (Tiyay) P.S. Case No. 70 of 2008 whereby the application of the petitioner under Section 311 of the Cr. P.C. has been rejected.

Mr. Ram Naresh Singh, learned counsel for the petitioner having AOR No.00241 submits that trial has already concluded, hence he seeks permission to withdraw the application. Permission is accorded.

Accordingly, the application is dismissed as withdrawn.
