JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Chanpatia Sirisiya P.S. Case No. 47 of 2019 registered for the offences punishable under Sections 272, 273, 414 of the Indian Penal Code and Sections 30(a), 30(b) and 37(c) of Bihar Prohibition and Excise Act.
Allegation is of recovery of liquor from the house of the petitioner.
Submission of learned counsel for the petitioner is that the house is joint house and he has falsely been implicated in this case.
Heard learned APP also.
In view of specific allegation of recovery of liquor from the house of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He may surrender
Patna High Court CR. MISC. No.39135 of 2019(2) dt.26-06-2019 2/2 and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
With the above observation, this application is dismissed.
