====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Nawada Town P.S. Case No. 389 of 2017 registered for the offence punishable under Sections 304(A), 276 of the Indian Penal Code and later on added Section 304 of the Indian Penal Code. The allegation of the informant is that he had taken his son to the Medical Hall of the accused persons wherein the petitioner had injected the injection, whereafter the son of the informant had died.

The learned counsel for the petitioner submits that there is no motive behind the incident, he is not responsible for the incident, he has a clean antecedent and is in custody since 10.06.2017. It is further submitted that the punishment for the

Patna High Court Cr.Misc. No.33612 of 2017 (2) dt.20-07-2017 2/2 offence is of one year and triable by the 1st Class, Judicial Magistrate, hence the petitioner should be granted bail. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Nawada Town P.S. Case No. 389 ofr 2017.
