ANJANA MISHRA ORAL ORDER 31-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 17.04.2018 in connection with Bithan P.S. Case No.38 of 2018 registered for the offence under Sections 307/34 of the Indian Penal Code and Section 25(1-B) A, 26 and 27 of the Arms Act. Learned counsel for the petitioner submits that though the petitioner has been apprehended from the field, yet it cannot be said with certainty that the petitioner has also indulged in the occurrence, as the firing was done by several persons and not particularly by the petitioner.

In view of the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail
