The petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is in custody since 20.03.2021, charges have been framed and has antecedent of thirteen cases.
Allegation is of looting the bank of Rs.14,42,170/- by six unknown criminals. Further the criminals even looted some customers also.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated merely because of his antecedent. He was not put on T. I. Parade and his name

No.54904 of 2021(2) dt.18-04-2022 2/3 transpired in the confessional statement of co-accused Pappu Kumar and Jitendra and thereafter, it is alleged that during the course of investigation that Rs. One Lac was recovered from his house. The learned counsel submits that the alleged recovered amount belongs to the Axis Bank as it was wrapped in a wrapper on which logo of Axis Bank was embossed and there is absolutely no investigation to connect the alleged recovered notes as that of the notes of the looted bank i.e. Gramin Bank. Learned A.P.P. opposes the bail application.
Considering the fact that the petitioner is in custody, charges have been framed and taking into consideration the submissions made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Nardiganj P. S. Case No.40 of 2021, subject to condition that one of the bailors shall be the wife of the petitioner namely, Kanchan Devi. Further the petitioner will appear on day to day basis in the trial. In the event, if the petitioner does not appear on two consecutive dates, the learned Court below shall forthwith cancel his bail bonds.
