This is an application for bail in connection with Dhanarua P.S.Case No. 382 of 2016 registered for the offences under Sections 25(1-B)(a), 26 of the Arms Act and 17 of C.L.A. Act.
Petitioner is not named in the FIR and on disclosure of his name by other co-accused he was arrested and from his possession one country made pistol and one rifle in damage condition have been recovered.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and earlier he has no criminal antecedent but after lodging the present case he has been made accused in one more case and he is in custody since
Patna High Court Cr.Misc. No.35905 of 2017 (2) dt.09-08-2017 2/2 27.3.2017.
Heard learned APP also.
Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.
However, learned trial court is directed to conclude the trial within five months. If trial is not concluded within the said period, petitioner may renew his prayer for bail. With the above observation, this application is dismissed.
