JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-04-2021 Heard Mr. Abhishek Kumar, learned Advocate for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Rajepur P.S. Case No. 181 of 2018, dated 30.10.2018, instituted for the offences under Sections 341, 323, 353, 504 and 34 of the Indian Penal Code.

The petitioner has not been named in the F.I.R. It appears from the prosecution case that several named and unnamed persons managed to take away a detainee from the custody of the police.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.38549 of 2020(2) dt.16-04-2021 2/2 that his name has transpired in the confession of an arrested accused person. It has further been submitted that some of the named accused persons of this case, viz., Suman Kumar and Rajan Kumar have been granted anticipatory bail by this Court on 11.02.2019 passed in Cr. Misc. No. 7622 of 2019. The petitioner has clean antecedents.

Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sadar, Motihari, East Champaran in connection with Rajepur P.S. Case No. 181 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
