Petitioner seeks bail in a case registered for the offence punishable under Section 364A of the Indian Penal Code. The FIR of the occurrence of abduction of Sanjay Sao the son of the informant is against unknown. Name of the petitioner did not figure in the statement of the victim recorded under Section 164 Cr.P.C. However, after two months of the occurrence again statement of the victim was recorded by the police wherein the name of the petitioner also transpired. Considering the fact that after recovery of the victim only offence of abduction simplicitor is made out, let the petitioner, above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.37282 of 2017 (8) dt.05-03-2018 2/2 bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 149 of 2016 arising out of Lakhisarai Police Station Case No. 300 of 2003, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
