The petitioner apprehends his arrest in connection with Nasriganj P.S. Case No. 36 of 2020 registered under Sections 341, 323, 354, 376, 504, 506, 498(A) and 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Petitioner is the husband of the informant. Further submission is that the F.I.R. has been lodged
Patna High Court CR. MISC. No.3209 of 2021(3) dt.18-11-2021 2/2 against the petitioner after one year of alleged occurrence. There is no reasonable explanation as to why the F.I.R. has been lodged after one year of delay. Petitioner has no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Chief Judicial Magistrate, Sasaram, Rohtas in connection with Nasriganj P.S. Case No. 36 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
