JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-09-2015 Heard learned counsels for the petitioner and the State. The petitioner no.1 being unmarried sister and petitioner nos. 2 and 3 being the parents of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 341, 323 and 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The accusation is of pouring kerosene oil by petitioner no.1 and 2 over the body of the victim/daughter of the informant, when petitioner no.3 lit fire as a result the victim received burnt injuries and subsequently the she succumbed to the injuries. It is submitted by learned counsel for the informant that the victim in her subsequent statement also supported the accusation levelled in the FIR.
Considering the fact that petitioner no.1 is unmarried
Patna High Court Cr.Misc. No.42805 of 2015 (2) dt.10-09-2015 2/2 girl, let her be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Lakhisarai in connection with Lakhisrai (Kawaiya) P.S. Case No. 408 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. So far as petitioner nos. 2 and 3 are concerned, this Court is not inclined grant anticipatory bail to them. Accordingly, the application with regard to petitioner nos. 2 and 3 is rejected.
