Petitioner seeks bail in a case registered for the offence punishable under Section 47(a) of the Excise Act. 27 liters of Toddy is said to have been recovered from the hut of the petitioner but submission on behalf of the petitioner is that the aforesaid recovery is said to have been made on 03.05.2016 but prior to aforesaid recovery, the Municipality settled the trees with the petitioner on 20.04.2016, which is evident from perusal of Annexure-2 to this petitioner. Moreover the petitioner does not have any criminal antecedent and languishing in jail custody since 04.05.2016. Considering the aforesaid facts and circumstances as
