Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.
Petitioner seeks bail in a case initially, registered under section 365 of the Indian Penal Code and subsequently, converted into sections 302, 364, 201, 379, 120B/34 of the Indian Penal Code. Petitioner lodged the present case against unknown regarding missing of her husband but in course of investigation, it came to light that petitioner was the first wife of Sunil Kumar Singh but subsequently, she solemnized her marriage with the deceased and her first husband started working at Khatal of the deceased. First husband of the petitioner, namely, Sunil Kumar Singh was arrested on the basis of call details and disclosure made by co- accused Sunil Kumar Singh, petitioner was also arrested and confessed her guilt.
Patna High Court Cr.Misc. No.26406 of 2016 (6) dt.08-09-2016 2/2 Admittedly, none has seen the actual killing of the deceased and the entire case hinges upon circumstantial evidence. Petitioner is in jail custody since 9.1.2016 and investigation against her has already been completed.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl.
