JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Kadwa P.S. Case No.12 of 2020 (G.R. No. 346 of 2020) for the offence under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent.
The allegation against the petitioner is that the petitioner and others objected to the measurement of land and thereafter scuffle took place in which the petitioner has assaulted the informant. Petitioner is in custody since

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 26.06.2020, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in connection with Kadwa P.S. Case No.12 of 2020 (G.R. No. 346 of 2020).
