1. Heard learned counsel for the petitioner Mr. Manish Kumar No.2 assisted by Mr. Gajendra Kumar Singh and learned APP for the State Mr. Anil Kumar.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 341, 323, 307 and 504 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that partition was effected through panchayati after the time fixed by the panches was over, the informant asked his relative to vacate the premise when eight named accused persons including the petitioner hatched conspiracy to kill him. No.45374 of 2026(2) dt.14-07-2026 2/3 coming back home, Sunil assaulted him by rod causing fracture of hand thereafter petitioner assaulted Gauri by Axe on orders of Ram Chandra causing injury on head. Further, Faresh Yadav assaulted by rod and Kapur Devi tried strangulating her while Soni Devi and Sadhu Yadav snatched her chain.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that from perusal of the allegations as alleged in the FIR, it would manifest that on account of dispute relating to property, the occurrence is alleged to have taken place. It is further submitted that informant of the instant case is Krishna Yadav and his father Ram Chandra Yadav had instituted Neemchak Bathani P. S. Case No.46 of 2022 dated 28.03.2022. It is next submitted that inadvertently the said FIR could not be annexed in the instant anticipatory bail application and in place of the said FIR, Neemchak Bathani P. S. Case No. 146 of 2022 dated 21.08.2022 has been annexed inadvertently. It is further submitted that though petitioner is alleged to have assaulted Gauri by Axe on orders of Ram Chandra causing injury on head, but then injury suffered by Gauri has been opined to be simple in nature as would manifest from the order impugned. It is reiterated and submitted that

5. Learned A.P.P. opposes the anticipatory bail application.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Neemchak Bathani P. S. Case No.47 of 2022, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
