JUSTICE SANJAY PRIYA ORAL ORDER 28-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 323, 364 and 307/34 of the Indian Penal Code.

The case of the prosecution is that while the informant was taking meal in the house of his grand maternal father, three persons named in the first information report came on a motorcycle and took him away to various places and they called some other persons on mobile phone and the petitioner was also among them.

It is submitted on behalf of the petitioner that another co-accused person namely Santosh Yadav having similar allegation has been granted bail by a co-ordinate Bench of this

Patna High Court Cr.Misc. No.265 of 2017 (2) dt.28-01-2017 2/2 Court in Cr.Misc. No. 53014 of 2016 on 20.12.2016. From the written report it appears that no allegation of specific overt act is attributed against the petitioner. The petitioner is said to be in custody since 04.06.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti P.S.Case No. 186 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
