Petitioner seeks bail in Araria P.S. Case No.691 of 2017 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Araria.
It is alleged that informant was not ready to solemnize marriage of his daughter with the petitioner due to which petitioner assaulted with brick on his eyes due to which he sustained injures.
Counter Affidavit has been filed by the informant, wherein, injury report of the informant is annexed as AnnexureA, wherein, doctor has stated that there was complete loss of
Patna High Court Cr.Misc. No.51496 of 2018 (3) dt.27-09-2018 2/2 vision of right eye and injury was grievous in nature. It is also submitted by the counsel for the informant that he went to different places in connection with treatment of his eye due to which delay has occurred in filing the case.
In such circumstances, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected. Liberty is given to the petitioner to renew his prayer for bail after six months if no substantial progress is made in the trial.
