The petitioner seeks bail in Kamtaul P.S. Case No. 28/2017, instituted for the offence under Section 302 of the Indian Penal Code.

It is alleged in the written report that the police got information that one unknown dead body is lying on Hariharpur, Malpatti Road. The police party reached at the place of occurrence. The dead body could not be identified by anyone. Learned counsel for the petitioner has submitted that during investigation, it has come that deceased was going to supply 297 packets of refine Dhara oil. He was murdered by some unknown persons. It is further submitted that petitioner was

Patna High Court Cr.Misc. No.59746 of 2018 (2) dt.08-10-2018 2/2 arrested by the police in Bidupur P.S. Case No. 60/2017 for offences under Sections 8/20(b)(ii)(c) of N.D.P.S. Act and Section 414 of the Indian Penal Code and his confessional statement was recorded in that case, in which he has confessed his involvement in the instant case and also disclosed the name of other associates who were involved in murder of the deceased and loot of said Dhara oil. At the instance of petitioner, looted Dhara oil was recovered from the house of one Dhiraj Jha. Petitioner is not named in the written report. He is in custody since 19.01.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.

10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge, Darbhanga in S.Tr. No. 273/2018, arising out of Kamtaul P.S.
