The petitioner seeks bail in a case instituted for the offences under Sections 354(B), 354(C), 376(G) of the Indian Penal Code and sections 67, 67(a) and 67(b) of the I.T. Act. The prosecution allegation in short is that the accused persons outraged the modesty of the daughter of the informant. It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.3.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The statement of the victim has been recorded under Section 164 Cr.P.C. in which allegation of commission of rape is alleged against co-accused Dharmendar

Patna High Court CR. MISC. No.40369 of 2019(2) dt.02-07-2019 2/2 Yadav. There is no allegation of commission of rape alleged against the petitioner. Other similarly situated co-accused have been granted bail vide Annexure-3 and 3/A to the present application by a co-ordinate Bench of this Court. On behalf of the State, it is submitted that the petitioner is named in the F.I.R..

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jamui in connection with Jhajha P.S. Case No. 117/18.
