====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 13-07-2015 Heard learned counsel for the petitioners and learned counsel for the opposite parties.

Counsel for the petitioners has made a complaint about violation of order dated 15th September 2009 passed in I.A. No. 5857 of 2009 complaining that the opposite parties have alienated the trees standing over plot nos. 205 and 207 which has been prohibited by the Court.

Counsel for the petitioners submits that earlier opposite parties have sold some trees but at present they are maintaining status quo and not disturbing any trees from the aforesaid plots.

Counsel for the opposite parties has denied the allegation of selling of trees standing over the aforesaid plots. Counsel for the petitioners is satisfied with the

Patna High Court MJC No.2759 of 2010 (7) dt.13-07-2015 2/2 present situation of maintaining the status quo, it is very difficult for this Court to arrive a conclusion that the tree was a subject of sale by the opposite parties earlier as the both the parties are maintaining status quo, in this view of the matter, there is no need to proceed with the matter.

Accordingly, this petition is disposed of.
