The petitioner seeks bail in a case registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code in connection with Jakanpur P.S. Case No. 249/2016. The petitioner is not named in the F.I.R. It appears that he has been made accused on the basis of his confession. Submission of the learned counsel for the petitioner is that there is no recovery from possession of the petitioner and he has not been put on Test Identification Parade. Further the petitioner has remained in custody for eight months. It has also been submitted that at the time of arrest he has been remanded from six other cases of similar type without having any material in
Patna High Court Cr.Misc. No.39416 of 2017 (3) dt.01-09-2017 2/2 those cases. He is on bail in those cases.
Heard learned Additional Public Prosecutor also. Having heard both sides, in view of the facts, stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Jakkanpur P.S. Case No. 249/2016, subject to conditions that one of the bailors should be close relative of the petitioner and another having sufficient immovable property within the jurisdiction of the court below with further condition that he will make himself available before the police in the concerned police station in first week of each months till conclusion of trial, otherwise his bail bond will be cancelled.
