2. The petitioner apprehends arrest in connection with Naurangiya P.S. Case No. 63 of 2024 for the offence registered under Section 30(a) of Bihar Prohibition & Excise Act.

3. As per the prosecution case, 11.25 litres English liquor was recovered from bag kept on a motorcycle which belongs to the petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case being the owner of the seized motorcycle which has already been sold to co-accused Sonu Sahni. Petitioner has no knowledge about the misuse of motorcycle in the transportation of the illicit liquor. Petitioner has no concern after the sell of the

The petitioner filed copy of the sale deed dated 20.12.2023 with respect to the sale of the seized motorcycle to co-accused and the occurrence took place on 11.09.2024. Petitioner has no criminal antecedent as stated in paragraph no. 3 of the bail petition. He undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Bagaha, West Champaran, in connection with Naurangiya P.S. Case No. 63 of 2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
