Petitioner is languishing in judicial custody since 12.05.2017 in connection with Jhajha P.S. Case No. 117 of 2017 for offences punishable under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code.
The prosecution case, as lodged by the informant, is that while he was constructing his house on his land, the petitioner who is his uncle along with his cousin brother and aunt came with weapon and abused him and the petitioner caused Tangi and rod blow to the informant and his father Jetha Soren. It has been submitted by the learned counsel for the petitioner that he is innocent, and there was a property dispute
Patna High Court Cr.Misc. No.37079 of 2017 (3) dt.23-08-2017 2/2 between both the parties, who are agnates and that a counter case was lodged bearing Jhajha P.S. Case No. 118 of 2017 for the same occurrence on the same day. He submits that injury found on the informant and his father has been opined to be simple. Chargesheet has already been submitted and there is no allegation of tampering with the prosecution witnesses by the petitioner. However, learned APP for the State opposes the prayer for bail.
Be that as it may, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamui, in connection with Jhajha P.S. Case No. 117 of 2017 subject to the condition that one of the bailors would be a close relative of the petitioner.
