The petitioner apprehends his arrest in Nawada Town P.S. Case No.337 of 2017 registered under Sections 420, 120(B) and 34 of the Indian Penal Code and under Section 156 of the Representation of the People Act.

The informant (District Transport Officer-cum-Nodal Officer) alleged that the vehicle bearing Registration No.BR27B-2507 was requisitioned for the purpose of holding panchayat election. Sanny Kumar (petitioner) was the driver of the said vehicle. The driver of the vehicle received Rs.14,00/- as advance but after sometimes he fled away with the vehicle causing inconvenience and hindrance in holding panchayat election.

Learned counsel for the petitioner submits that no

Patna High Court CR. MISC. No.39415 of 2019(2) dt.27-06-2019 2/2 offence under Section 420 of the IPC is made out. The petitioner fell ill and he went to the doctor for treatment but when the petitioner returned, he was informed that the case has already been registered.

Having considered the facts and the nature of allegation made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawada in connection with Nawada Town P.S. Case No.337 of 2017, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
