JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 21-07-2015 The writ application is disposed of with a direction upon the Collector- cum- District Magistrate, Samastipur that the petitioner's claim for allotment of a pucca house in terms of the policy of the State Government formulated by the Disaster Management Department must be carried out in letter and spirit. If an application is filed by the petitioner with a copy of this order, a decision on the claim of the petitioner in terms of Annexure- 9 policy must be taken and communicated to the petitioner within a period of three months. It is rather unfortunate that the citizens of Bihar affected by natural calamity have to run to the High Court for direction for

Patna High Court CWJC No.18295 of 2010 dt.21-07-2015 2/2 implementation of the welfare scheme and in the writ application, which was filed in the year 2010, no counter affidavit has been filed. It does not reflect well on the district administration of the State, who are obviously callous in their approach towards the sensitivity and the problems of the downtrodden.

The writ application is disposed of in terms of the above direction with a clear understanding that if no decision is taken within the time frame, the Collector, Samastipur will be personally held liable by the Court. The Collector will take the direction in the right spirit.
