JUSTICE MUNGESHWAR SAHOO ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners, namely, Rekha Devi, Shyama Devi and Bhukho Devi apprehend their arrest in Begusarai SC/ST P.S. Case No. 182 of 2013 under sections 147, 323, 341, 337, 379 and 504 I.P.C. and Section 3(i)(x) of the SC/ST (Prevention of Atrocities) Act.

The learned counsel for the petitioners submitted that there is enmity between the parties. The allegation of commission of theft is against Manoj Sah and the abuse in the name of caste is against Raju Sah. All the petitioners are ladies. According to the learned counsel, no case under Section 3(i)(x) of the SC/ST

Patna High Court Cr.Misc. No.42208 of 2015 (2) dt.14-10-2015 (Prevention of Atrocities) Act is made out against the petitioners. On the other hand, the learned A.P.P. objected the prayer for anticipatory bail.

Considering the allegation made against the other coaccused persons I direct the petitioners named above to surrender before the court below within six weeks from today and on their so surrendering, the court below is directed to release the petitioners on bail on furnishing bail bonds of Rs.5,000/- (rupees five thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai SC/ST P.S.
