Petitioner seeks bail in connection with Asthawa Police Station Case No.37 of 2019 registered for the offences punishable under Sections 25(1-b)a, 26, 35 of the Arms Act pending in the court of learned Additional Chief Judicial Magistrate, Nalanda at Biharsharif.

Petitioner is in custody since 17.02.2019.

The report of the learned trial judge reveals that the prosecution evidence is not going on in the case for the reason that trial is pending in the vacant court.

The learned District Judge, Biharsharif shall ensure that case arising out of Asthawa Police Station Case No.37 of 2019 is transferred to a functional court and the learned trial

Patna High Court CR. MISC. No.40260 of 2019(4) dt.26-09-2019 2/2 judge is directed to expedite the trial and conclude the same preferably within 06 months without allowing unnecessary and long adjournment in the case.

With the aforesaid observation, I am not inclined to enlarge the petitioner, above named, on bail for the present considering the nature of allegation of recovery of firearm from the house of the petitioner and his criminal antecedents. (Birendra Kumar, J) abhishek/- U T
