ANJANA PRAKASH ORAL JUDGMENT Date: 04-01-2016 The Petitioner seeks revision of the judgment of conviction dated 19.4.2006 passed by the 1st Additional Sessions Judge, Rohtas, Sasaram in Criminal Appeal No.04 of 2005/ 02 of 2005, by which he has upheld the conviction of the Petitioner under Section 498A I.P.C. and maintained the sentence of 3 years R.I. and fine of Rs.2000/-, in default of which simple imprisonment for another three months, passed by judgment dated 15.1.2005 by the Judicial Magistrate, 1st class, Bikramganj, Rohtas in Complaint case No.21 of 2001 (Trial No.335 of 2005).
Having gone through the impugned judgment, I do not find any reason for interference. However, considering the period of custody of the Petitioner as also the date of occurrence, the sentence is
Patna High Court CR. REV. No.492 of 2006 dt.04-01-2016 2/2 modified to the period already undergone by him. However, he is required to deposit the fine as directed by the Court below within a period of eight weeks from the date of receipt of this order, failing which he shall be sentenced to imprisonment as directed by the court below.
With the aforesaid modification in sentence, the revision application stands dismissed.
