The petitioner seeks bail in Gopalpur P.S. Case No. 93 of 2021, registered for the offence punishable under Sections 302, 307 and other allied sections of the Indian Penal Code. As per the FIR, this petitioner along with other accused persons assaulted the father of informant on account whereof father of informant died. It is further alleged that they also assaulted the brother and maternal grand-mother of informant.

It is submitted on behalf of the petitioner that specific allegation of assault is against other co-accused Hussain Gaddi, by rod on the head of deceased. Admittedly, there is land dispute between the parties. Petitioner is next door neighbour and no specific overt act has been alleged against him rather allegation

Patna High Court CR. MISC. No.51378 of 2021(2) dt.29-11-2021 2/2 is general and omnibus. Petitioner claims clean antecedent and he is in custody since 01.06.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalpur P.S. Case No. 93 of 2021.
