JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant by her in-laws family members including the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the deceased and the deceased committed suicide and

Patna High Court CR. MISC. No.42742 of 2022(7) dt.04-05-2023 2/3 on the alleged date and time of occurrence, the petitioner was even not present there. The dead body of the deceased was recovered after breaking open the door, which was locked from inside. It is further submitted that family members of the informant were immediately informed about the occurrence and on the presence of the informant and the police personnel, the door was break open. There is general and omnibus allegation against all the F.I.R named accused persons including the petitioner. There is no prior complaint of harassment and torture or demand of dowry against the petitioner. The petitioner is languishing in custody since 02.03.2022. The independent witnesses have also not supported the case of the petitioner.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner and submitted that petitioner is husband of the deceased and he has fully responsible for the commission of suicide of his wife.

No.42742 of 2022(7) dt.04-05-2023 3/3 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Barh in connection with Mokama P.S. Case No. 345 of 2021, G.R. No. 1660 of 2021.
