The petitioner is apprehending his arrest in connection with Pakaridayal P.S.Case No.85 of 2019 registered for offences punishable under Sections 341, 323, and 498A/34 of the Indian Penal Code.

Petitioner happens to be husband of the informant. There is allegation against him of assault to the informant. Submission of the learned counsel for the petitioner is that a series of litigation has been levelled against the petitioner but in spite of that he is still ready to keep her with dignity and care. Opposite party no.2 has appeared on notice and submitted that she is also ready to reside with the petitioner , if she is allowed to live with dignity and care.

No.39761 of 2019(3) dt.17-08-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender on 26.8.2019 and on that day informant shall also remain present in the court below and further on filing an affidavit by the petitioner that he is ready to keep her with dignity and care and he will take her from the court below itself, he will be released on provisional bail in connection with Pakaridayal P.S.Case No.85 of 2019 for a period of six months and during that period, petitioner and the informant have to appear before the court below in the second week of each month so that the learned court below may watch their conduct and matrimonial relationship and once being satisfied with their conduct especially the conduct of the petitioner, he will confirm the bail bond of the petitioner otherwise he is free to pass any other order or orders as he deems fit an proper including cancelling the bail bond of the petitioner.

With the aforesaid direction, this application is disposed of.
