This is an application for bail in connection with Sessions Trial No. 146B of 2004, arising out of Bettiah Mufassil P.S. Case No. 264 of 2001 registered for the offences punishable under Sections 364A and 120B of the Indian Penal Code. Petitioner is not named in the FIR and it appears that his name transpires in confessional statement of co-accused. Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him and coaccused persons have been granted bail by co-ordinate Benches of this Court, vide orders as contained in Annexures 2 Series and petitioner is in custody since 31.7.2017 in the present case. Heard learned APP also.
Patna High Court Cr.Misc. No.46259 of 2017 (2) dt.20-09-2017 2/2 Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.
However, learned trial court is directed to expedite the trial of the petitioner and other co-accused persons and try to dispose of the same within four months. If trial is not concluded within the said period, the trial court will release the petitioner on bail to its own satisfaction, if an application for bail is filed on behalf of petitioner.
