JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-09-2017 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with (Darbhanga Nagar) Town P.S. Case No. 55 of 2017 for the offences punishable under Section 411, 414, 420, 467 and 379 of the Indian Penal Code.

The accusation against the petitioners is that when the police was on patrolling duty and they reached near Axis Bank on 11.4.2017, the petitioners were apprehended in a suspicious condition. From the possession of the petitioners, one mobile phone, keys of motorcycle, small iron hammer etc. were recovered.

No.45819 of 2017 (2) dt.20-09-2017 2/2 The learned counsel for the petitioners submits that the petitioners are innocent and nothing incriminating or stolen articles were recovered from their possession. It is further submitted that as far as the case pending against the petitioners is concerned, they have already been granted bail by this Court vide order dated 12.09.2017 passed in Cr. Misc. No. 43400 of 2017. It is further stated that the petitioners are in custody since 12.4.2017. Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Town P.S. Case No. 55 of 2017.
