2. The petitioner is in judicial custody in connection with Harnaut P.S. Case No.231 of 2023 for the offences punishable under Sections 363, 366(A)/34 of the Indian Penal Code lodged on 24.04.2023 by the informant, Jawahar Pandit.
3. As per the prosecution story, the informant alleged that his grand-daughter was taken away by the accused persons with an intention to get married. Accordingly, the FIR.
4. Learned counsel for the petitioner submits that they were in relationship and later the girl on the pressure of family members retracted/gave different statement resulting him
Patna High Court CR. MISC. No.44543 of 2024(5) dt.11-11-2024 2/3 to his judicial custody. Further, he points out that she refused to go through the medical examination as per her own signature on 17.10.2023.
5. Learned APP as also learned counsel for the informant oppose the prayer stating that the girl has narrated her ordeal that she was taken to different places and was forcibly kept.

Having heard the parties, the petitioner is 21 years of age, student, having no criminal antecedent, has already remained in custody since 17.10.2023 (para-10 of the petition), the girl chose not to go through the medical examination, he will be facing the trial, this Court is inclined to extend him the privilege of bail.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with aforesaid P.S. Case, subject to the following conditions: (i) one of the bailors should be the family member of the petitioner who shall provide official document to show his bona fide;
(ii) the petitioner shall appear on each and every date
Patna High Court CR. MISC. No.44543 of 2024(5) dt.11-11-2024 3/3 before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) perwez U T
