Mr.Amarendra Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-06-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with C2 139 of 2017, registered under Section 30A of the Bihar Liquor Prohibition and Excise Act.

The accusation is of recovery of one carton from the possession of Surendra Manjhi in course of fleeing away. On search of carton, 296 bottle, each containing 300 ML and 65 bottles, each containing 180 ML Nepali Soufi recovered. The apprehended person disclosed the name of petitioner Rambabu Paswan and Bhola Paswan as his associates, who succeeded to flee away.

Learned counsel for the petitioner submits that

No.39280 of 2019(2) dt.27-06-2019 2/2 petitioner has not been apprehended on the spot, rather, his name come in the confessional statement of Surendra Manjhi, who is said to be apprehended on the spot along with the alleged seized liquor. The petitioner has not criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. District and Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with C2 139 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
